Dr. Oumair Aejaz Sex Abuse Lawsuits

This page will look at sex abuse lawsuits against Dr. Oumair Aejaz. Dr. Aejaz was an internal medicine specialist in Michigan who practiced at Ascension Genesys Hospital and Henry Ford Macomb Hospital.

Dr. Aejaz has recently been criminally charged with a number of sex crimes after it was discovered that he was using hidden cameras to make secret videos of patients, both children and adults. The videos are of patients in vulnerable moments such as undressing, in bathrooms, or in hospital recovery areas.

About Dr. Oumair Aejaz

Dr. Oumair Ajez is originally from Indian and he relocated to the U.S. in 2011 as part of a medical internship program. Dr. Aejaz specializes in internal medicine and he did his residency training in Detroit at Sinai Grace Hospital. After completing his residency in 2018, Dr. Aejaz relocated to Alabama where he practiced for a short time.

Dr. Aejaz has primarily worked as a “contract physician,” which means that he worked for short time periods in various hospitals and clinics in numerous locations across the U.S. Most of his medical career, however, has been in either Alabama or Michigan.

After practicing in Alabama for a short time, Dr. Aejaz came back to Michigan and began practicing in the Oakland County area. Dr. Aejaz worked at 2 hospitals in Michigan: Henry Ford Macomb Hospital in Clinton Township, and Ascension Genesys Hospital in Grand Blanc Township. Dr. Aejaz was not an employee of either hospital. He worked for a third-party physician staffing group.

Allegations Against Dr. Aejaz

Dr. Aejaz is accused of making secret videos of patients when they were naked, unconscious, or in other vulnerable positions, and then viewing those videos for his own sexual gratification. Police investigators executed a search warrant to confiscate Dr. Aejaz’s personal computers at his home and they found over 13,000 secret patient videos. The subjects in the videos include numerous women and even children as young as age 2.

Most of the secret videos were taken of Dr. Aejaz’s own patients in the hospital or clinical settings. Dr. Aejaz also took secret videos of individuals in the hospital who were not his patients, such as people recovering from surgery.

It appears that Dr. Aejaz was also secretly recording his own wife. Dr. Aejaz’s wife has filed for divorce and sought a protective order against him. She claims that he installed hidden video cameras in their bedroom and bathroom and made videos of her without her consent.

Lawsuits Against Dr. Aejaz and the Hospitals

In addition to criminal charges, Dr. Aejaz will now also be facing a growing number of civil lawsuits by former patients and other victims who were secretly recorded. Dr. Aejaz himself clearly has direct liability to his victims. Unfortunately, however, he probably does not have the financial resources to pay damages to his victims.

The hospitals where Dr. Aejaz practiced and where he made his secret videos could also be liable for failing to protect victims from Dr. Aejaz. The primary hospitals where Dr. Aejaz worked were Henry Ford Macomb Hospital and Ascension Genesys Hospital. Ascension is a very large non-profit healthcare system that operates across the U.S., so it has ample financial resources to pay damages to victims.

Settlement Value of Dr. Aejaz Video Taping Lawsuits

It is very early to speculate on the potential settlement value of claims against Dr. Aejaz and the hospitals. This litigation is very new so we don’t know exactly how things could play out. That being said, we can speculate on the potential settlement payout value based on amounts that victims received in prior cases involving similar allegations.

The best comparable case is the 2014 settlement involving Dr. Nikita Levy. Dr. Levy was a gynecologist at Johns Hopkins in Baltimore. It was discovered that Dr. Levy had secretly recorded thousands of women during exams. A class action lawsuit was filed against Dr. Levy and Johns Hopkins on behalf his victims.

The Dr. Levy class action lawsuit was eventually resolved with a $190 million settlement. The settlement class included over 8,000 women. The settlement compensation payouts to individual victims varied depending on factors such as the nature of the patient’s harm. The actual payouts ranged from $1,800 to $25,000, with a few victims getting higher amounts.

The settlement payouts in any class action or similar litigation against Dr. Aejaz could potentially be much higher. Why? There are several reasons we think the settlements in a case against Dr. Aejaz could be higher:

  • Aejaz’s Action Were Arguably Worse: Compared to Dr. Levy, Dr. Aejaz’s actions were arguably worse in many ways. Dr. Aejaz may have recording sexual assaults on unconscious women while they were recovering from surgery. He also recorded young children.
  • Settlements in Sex Abuse Cases are on the Rise: The settlement payouts in sex abuse lawsuits are on the rise across the country. Increased public awareness and sympathy from movements such as #MeToo and increased news coverage. A number of new laws have also give abuse victims more leverage.
  • Inflation: The settlements in the Dr. Levy case are now 10 years old, so just due to inflation we would expect the payouts today to be higher.

Victims Can File Claims and Get Compensation

You don’t need to have proof that you were recorded in order to seek justice. In cases similar to other well-known incidents involving predatory doctors who used hidden cameras—such as the case against Johns Hopkins gynecologist Dr. Nikita Levy—victims were still eligible for compensation due to the emotional and psychological trauma they experienced upon discovering the abuse. If you were treated by Dr. Aejaz and now suffer from anxiety, fear, loss of trust in medical professionals, or other psychological harm, you may be entitled to compensation even if you never saw a recording.
