The question is if the defense picks a doctor who is hard to subpoena and unlikely to produce financial records and bias materials, what should the court do?\u00a0 Because that creates a real fairness problem for the plaintiff.<\/p>\n<p data-start=\"1238\" data-end=\"1599\">This is not a minor procedural fight. Defense medical exams are often built around one goal: creating testimony from a paid doctor who will minimize the plaintiff\u2019s injuries.
