{"id":2965,"date":"2023-09-05T18:46:53","date_gmt":"2023-09-05T22:46:53","guid":{"rendered":"https:\/\/www.millerandzois.com\/youtube-deposition-motion\/"},"modified":"2025-04-19T10:32:50","modified_gmt":"2025-04-19T14:32:50","slug":"youtube-deposition-motion","status":"publish","type":"page","link":"https:\/\/www.millerandzois.com\/professional-attorney-information-center\/pre-trial\/sample-motions\/motion-youtube-videos\/youtube-deposition-motion\/","title":{"rendered":"Motion to Take Down YouTube Depositions Response"},"content":{"rendered":"<div><strong>This is Part 2 of our motion opposing a doctor&#8217;s lawyer&#8217;s motion to take down our YouTube video of the doctor&#8217;s deposition.\u00a0 You can find <a href=\"\/professional-attorney-information-center\/pre-trial\/sample-motions\/motion-youtube-videos\/\">Part 1 here<\/a>.\u00a0<\/strong><\/div>\n<div><strong>\u00a0<\/strong><\/div>\n<ol start=\"6\" type=\"A\">\n<li>All of the cases cited by Defendants are distinguishable from the instant case because they dealt with specific findings of fact regarding 1) particular content; and 2) the relief requested was specifically focused on regulating that content.<\/li>\n<li>In support of their argument, Defendants cite numerous cases where courts have issued protective orders. However, each of these cases is distinguishable from the relief requested in this case, which is overly broad and not based upon any specific facts.Defendants cite <u><a href=\"https:\/\/law.justia.com\/cases\/maryland\/court-of-special-appeals\/1999\/862s98-1.html\">Mullaney v. Aude<\/a><\/u>, 126 Md. App. 639 (1999), but that case dealt with the issuance of a protective order after a male defense counsel attempted to gain an unfair advantage against a female Plaintiff&#8217;s counsel at a deposition by calling her demeaning names. Clearly, the trial court was prohibiting specific conduct that was abusive, which is completely different than the conduct in this case which simply involves the posting an unedited, unaltered videotaped deposition on the internet of a Defendant who gave testimony under oath. To be sure, 99% of Dr. Martin&#8217;s deposition testimony involves her treatment of Jonathan Valladares, which she also publicly testified about at trial. It seems anomalous that Dr. Martin was perfectly fine testifying about this information at trial but is somehow embarrassed by her deposition testimony now.
