Medtronic Class Action Lead Recall MDL
On February 27, 2008, the Judicial Panel on Multi-District Litigation (MDL) issued a transfer order, transferring all Medtronic Sprint Fidelis lead cases to federal court in Minnesota. Minnesota was chosen because Medtronic is headquartered in Minnesota and “relevant discovery may be found there” and because the district is “centrally located.”
The Judicial Panel on Multidistrict Litigation, are seven federal judges appointed by the Chief Justice of the U.S. Supreme Court that can transfer lawsuits that arise under the same set of fact to a judge - known as the transferee judge - in one jurisdiction.
An MDL is called a class action but it is techincally not always - or even usually - a class action. In the Medtronic cases, for example, there are issues of fact common to all of these cases. Discovery as to the safety of the Medtronic defibrillator leads, when Medtronic first knew or should have known of the problem, and the like are common issues that will be critical to every case. After that discovery is completed, the cases will either settle or they will be sent back to the state in which it was filed for trial.
